Rental Rights;
if you are being evicted
By the end of this section, you will:
- Know what to do if you receive an eviction notice from your landlord or letting agent
- Know where to get support if you are homeless or at risk of homeslessness
Legal Support
Getting an eviction notice is unpleasant and can be very distressing.
The most important thing to remember is to seek professional support immediately, either from Shelter Cymru, Citizen’s Advice or the Council’s Housing Support Team.
The flowchart below might help you.
Remember, don’t panic! Your landlord has to follow the correct procedure to evict you, so you will not have to move right away. In some cases, you can be supported to stay in your home.
Valid or Not
An eviction notice will not be valid if…
It was issued within 6 months of the start of the tenancy
It gives you less than 6 months’ notice period
You were not provided with a Written Contract within 14 days
Your landlord / agent is not registered and licensed
The property is not Fit for Human Habitation
Never assume a notice is not valid! Check first by contacting Shelter Cymru or Citizen’s Advice.
Do not withhold rent unless you have taken legal advice.
Do not breach your contract rules even if an eviction notice is not valid.
Always be polite and keep communicating with your landlord / agent.
